BootRacer - End-User License Agreement
TERMS AND CONDITIONS - END-USER LICENSE AGREEMENT FOR BootRacer
You should carefully read the following terms and conditions before using this software. The use of this software indicates your acceptance of these terms and conditions. If you disagree with them, do not use the software.
INSTALLATION AND USE
BootRacer is freeware for non-commercial use.You may install this program for non-commercial use without any limitations.
It is not free software for use in the business. For business use you are must use the Business or Premium Version of the software.
You may install this program for business to test and evaluate for 30 days; after that time, you must either register this program or delete it from your computer hard drive. Unregistered business use of BootRacer after the 30-day evaluation period violates the United States and international copyright laws.
BootRacer Free License
You may use the licensed software for non-commercial use.
BootRacer Premium or Business License You may use the licensed software at work, for a commercial purpose, in a commercial context or environment. You may not use or execute two or more copies of the licensed software simultaneously (e.g., on a server and your home or work PC).
BootRacer Roaming License
The Roaming license allows an Administrator to run BootRacer from a CD or floppy or USB device on a specified # of machines up to an unlimited machine site license. You may use the licensed software at work, for a commercial purpose, in a commercial context or environment. You may copy BootRacer software only for a backup purpose, not for transferring BootRacer software to another person. You may not use or execute two or more copies of the licensed software at the same time.
BootRacer Site License
The Site license allows you to install BootRacer software to an unlimited number of computers in your company. You may use the licensed software at work, for a commercial purpose, in a commercial context or environment. You may copy BootRacer software only for a backup purpose, not for transferring BootRacer software to another person.
DISTRIBUTION
This software may be distributed freely on online services, bulletin boards, or other electronic media as long as the files are distributed in their entirety. This software may be distributed on CD-ROM, disk, or other physical media without the permission of Greatis Software.
PROHIBITION ON REVERSE ENGINEERING, DECOMPILATION, AND DISASSEMBLY
You may not alter this software in any way, including changing or removing any messages or windows.You can not decompile, reverse engineer, disassemble, or otherwise reduce this software to a perceivable human form. You may not modify, rent or resell BootRacer software for profit, or create derivative works based upon this software. You may not publicize or distribute any registration code algorithms, information, or registration codes used by this software without permission of Greatis Software.
RENTAL
You may not rent, lease, or lend the BootRacer.SUPPORT SERVICES
Greatis Software may provide you with support services related to the BootRacer ("Support Services"). Any supplemental software code provided to you as part of the Support Services shall be considered part of the BootRacer and subject to the terms and conditions of this EULA.UPDATES
The BootRacer periodically checks for updates from Greatis Software and downloads and installs them for you. By accepting this agreement, you agree to receive these types of automatic updates without any additional notice.DATA COLLECTION
You agree that Greatis Software collect, use, store and transmit technical and related information that identifies your computer (including Internet Protocol Address), operating system, application usage and error reports that may be gathered to facilitate the provision of software updates, dynamically served content, product support and other services to you, including online services.Greatis Software will never share, sell or lease this data to third parties or use it for any other purpose than making our services better for our users. Greatis Software collects diagnostic information for debugging purposes, and anonymous usage analytics of our apps and website to offer you a better user experience.
TERMINATION
Without prejudice to any other rights, Greatis Software may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT in your possession.COPYRIGHT
All title, including but not limited to copyrights, in and to the BootRacer and any copies thereof are owned by Greatis Software or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by Greatis Software.
NO WARRANTIES
Greatis Software expressly disclaims any warranty for the BootRacer. The BootRacer is provided "As Is" without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, noninfringement, or fitness of a particular purpose. Greatis Software does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the SOFTWARE PRODUCT. Greatis Software makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. Greatis Software further expressly disclaims any warranty or representation to Authorized Users or to any third party.
LIMITATION OF LIABILITY
In no event shall Greatis Software be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of "Authorized Users" use of or inability to use the BootRacer, even if Greatis Software has been advised of the possibility of such damages. In no event will Greatis Software be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. Greatis Software shall have no liability with respect to the content of the BootRacer or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.
